  • Personal Data Controller

    • The personal data controller, RPS s.r.o., Company ID No.: 23729112, with its registered office at Průmyslová 199/2, 250 64 Měšice, entered in the Commercial Register maintained by the Municipal Court in Prague, Section C (hereinafter referred to as the “ Controller”), declares that all personal data processed by the Controller is strictly confidential. The Controller handles such data in accordance with national legislation and European Union legislation applicable to the protection of personal data.
    • The Controller collects, stores and uses your personal data within the meaning of Act No. 110/2019 Coll., on Personal Data Processing (hereinafter referred to as the Personal Data Processing Act), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “ GDPR”). The individual purposes for which the Controller processes personal data are specified below.
    • The Controller also collects personal data through its website at parkdecor.cz (hereinafter referred to as the “ Website”).
    • The Controller issues this Privacy Policy in order to provide you with sufficient information about what personal data the Controller processes, for what purpose, for how long, who will have access to your personal data and what rights you have. This Privacy Policy applies to all personal data collected by the Controller, whether collected for the purposes of performing a contractual relationship, complying with a legal obligation, pursuing a legitimate interest or on the basis of consent granted.
  • Data Processed

    • The Controller is entitled to process the following personal data according to the purpose of processing, categories of personal data, categories of data subjects, categories of recipients and retention period as set out below.
    • The individual purposes of processing are understood as follows:
      • performance of a contractual relationship means: the relationship between you and the Controller arising on the basis of an order, registration, a concluded agreement, an application and participation in a competition, and similar circumstances;
      • sending commercial communications and offering products and services means: sending commercial offers by electronic mail (email), short text messages or telephone calls;
      • accounting and tax purposes means: maintaining accounting records in accordance with accounting and tax legislation;
      • personnel and payroll administration means: entering into employment agreements, payroll processing and payment of social security and health insurance contributions pursuant to Act No. 262/2006 Coll., the Labour Code, Act No. 582/1991 Coll., on the Organisation and Implementation of Social Security, and Act No. 48/1997 Coll., on Public Health Insurance and on Amendments and Supplements to Certain Related Acts;
      • statistical purposes means: anonymised measurement of Website traffic, including monitoring the number of page views, time spent on the Website and the type of device used to access the Website. We collect this data in order to improve the services provided and offer relevant content to our clients;
      • displaying advertisements means: displaying advertisements on the Website based on statistically identified customer preferences;
      • legitimate interest means: effective defence in the event of a dispute; in such a case, the personal data processing period is 4 years from the expiry of the warranty period for the goods and is extended by the period during which the dispute is ongoing. We seek to continuously improve our services and, where appropriate, provide new and better services; we also seek to prevent such activities from being obstructed. Activities that contribute to achieving this objective therefore constitute our legitimate interest. Legitimate interest also includes processing for the purposes of fraud prevention (e.g. assessing the risks associated with entering into an agreement), direct marketing (e.g. offering relevant services to existing customers), transferring personal data within a group of undertakings for internal administrative purposes, reporting criminal offences and transferring personal data to the competent authority, and ensuring network and information security. This list is illustrative only;
      • compliance with other legal obligations means: providing information to law enforcement authorities, providing information to other public authorities and similar activities.
    • We process your personal data for the period strictly necessary to ensure all rights and obligations arising from mutual legal dealings, at least for the period necessary to process an order, complete a transaction, arrange a service, etc., and subsequently for the period during which the Controller is required to retain personal data under generally binding legal regulations or for the period for which you may have granted consent to the Controller. Otherwise, the processing period is determined by the purpose for which the personal data is processed or by applicable legislation.
    • Personal data is processed by the Controller both manually and by automated means. The Controller is entitled to process certain information automatically, for example in order to generate statistical information about Website traffic.
  • Personal Data Processed on the Basis of Consent

    • If we have obtained your consent to the processing of personal data, such consent has been obtained for one of the following purposes:
  • Rights of the Data Subject

    • As a data subject, you have the rights set out below, which arise from applicable legislation and may be exercised at any time. These include:
      • the right of access to personal data, under which you have the right to obtain information from the Controller as to whether the Controller processes your personal data. The Controller is obliged to provide this information to you without undue delay. The content of such information is determined by Article 15 of the GDPR. The Controller has the right to request reasonable compensation for providing the information, not exceeding the costs necessary to provide it;
      • the right to rectification or erasure of personal data, or restriction of processing, under which you have the right to have personal data that is inaccurate or incorrect rectified. If your personal data is no longer necessary for the purposes for which it was collected, or if it is being processed unlawfully, you have the right to request its erasure. If you do not wish to request the erasure of personal data but only to temporarily restrict its processing, you may request restriction of processing;
      • the right to request an explanation if you suspect that the Controller’s processing of personal data is contrary to applicable legislation;
      • the right to contact the Office for Personal Data Protection if you have doubts regarding compliance with obligations related to the processing of personal data;
      • the right to data portability, i.e. the right to obtain personal data concerning you that you have provided to the Controller in a structured, commonly used and machine-readable format; for further details, see Article 20 of the GDPR;
      • the right to object to the processing of personal data processed for the performance of a task carried out in the public interest or in the exercise of official authority, or for the purposes of protecting the Controller’s legitimate interests. The Controller shall cease processing without undue delay unless it demonstrates that there is a legitimate interest/reason for the processing which overrides your interests, rights or freedoms;
      • the right to withdraw your consent to the processing of personal data at any time if you have granted the Controller consent to process your personal data.
  • Cookies

    • Cookies are short text files that a Website sends to your browser. They allow the Website to record information about your visit, such as your selected language and similar information, making your next visit to the Website easier and more convenient. Cookies are important because without them browsing the Internet would be considerably more difficult. Cookies enable better use of our Website and allow its content to be adapted to your needs; they are used by almost every Website in the world. Cookies are useful because they improve the user experience when repeatedly visiting a Website.
    • The Controller may use the following types of cookies on the Website:
      • Session (i.e. temporary) cookies allow us to link your individual activities while you browse the Website.
